Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LeadIQ360 platform ("Service") provided by LeadIQ360 ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

LeadIQ360 is a cloud-based customer relationship management (CRM) platform designed for real estate brokers and channel partners in India. The Service includes lead management, call tracking, WhatsApp campaigns, AI-powered insights, website builder, and related tools as described on our website.

2. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 18 years old to use the Service.
• One person or legal entity may maintain only one free account.
• You are responsible for all activity that occurs under your account.

3. Payment Terms

• Paid plans are billed monthly or annually as selected at the time of subscription.
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely through our payment partner. We do not store your payment card details.
• Annual subscriptions are billed upfront for the full year.
• We reserve the right to change pricing with 30 days' advance notice. Existing subscriptions continue at the current price until renewal.
• Failed payments may result in downgrade to the Free plan after a 7-day grace period.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Send unsolicited bulk messages (spam) through our WhatsApp or SMS features.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to store or transmit malicious code or content.
• Exceed reasonable usage limits or abuse API rate limits.
• Resell or redistribute the Service without our written permission.

5. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is owned by LeadIQ360 and protected by intellectual property laws. You retain ownership of the data you input into the platform. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

6. Data Ownership & Portability

Your CRM data (contacts, properties, deals, call logs, etc.) belongs to you. You may export your data at any time in CSV or JSON format. Upon account termination, we will retain your data for 30 days to allow export, after which it will be permanently deleted.

7. Limitation of Liability

To the maximum extent permitted by law, LeadIQ360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

9. Termination

• You may cancel your account at any time from the Settings page.
• We may suspend or terminate your account for violation of these Terms with prior notice.
• Upon termination, your right to use the Service ceases immediately.
• Sections on Intellectual Property, Limitation of Liability, and Governing Law survive termination.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app banner at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
